TAPP Terms & Conditions
The Appliance Care Company (TACC), Terms and Conditions (T&C), for Total Appliance Protection Package (TAPP) service agreements.
The Total Appliance Protection Package (TAPP) is a service agreement for one year that covers the repair or replacement of parts and components of your home’s appliances when they break down due to normal wear and tear. Normal wear and tear is considered use of an appliance as provided in the documentation/owner’s manual/user guide when the appliance was first purchased. TACC assumes responsibility for determining if appliance is being used within operating expected procedures.
A. Package Descriptions
- The Essentials service plan provides coverage on one clothes washer, one clothes dryer, one refrigerator, and one stove free standing. The Essentials plan includes one annual refrigerator inspection & cleaning of condenser coils if required. Does not included built-in or high-end versions of covered appliances. See section “I” below for definitions of built-in and high-end appliances. TACC technicians are solely responsible for determining if an appliance is built-in or high-end.
- The Standard service plan provides coverage for all items in the Essentials plan plus, one microwave, one deep freezer, one dishwasher, and one cooktop. The Essentials plan includes one annual dryer vent inspection and dryer vent cleaning if required. Does not include built-in or high-end versions of covered appliances. See section “I” below for definitions of built-in and high-end appliances. TACC technicians are solely responsible for determining if an appliance is built-in or high-end.
- The Ultimate service plan provides coverage for all items in the Standard plan plus, one wall oven, and one stand-alone ice machine. The Ultimate plan includes service on covered appliances that are considered by TACC to be built-in. The Ultimate service plan also includes service on certain high-end appliances. TACC technicians are solely responsible for determining if an appliance is built-in or high-end.
B. Conditions
- Your TAPP applies to only one (1) single-family dwelling and includes the repair and not the replacement of the appliances installed within that residence covered under your TAPP. Appliances are NOT covered if they are being used at a business, or for communal use purposes.
- Commercial grade appliances used in a residence for single home use can be covered with TAPP. The TACC technician determines these conditions upon service.
- TAPP can be purchased by residential landlords, but TAPP coverage plans are to be set up for each of your residential property addresses.
- In the event there are duplicate appliances of any one type, TACC reserves the right to designate which of the duplicate appliances is the household’s primary appliance. Primary appliances are first considered to be the appliance in a room typically designated for that appliance. For example, if a house has two refrigerators, the refrigerator in the kitchen will be designated as the primary appliance. The primary appliance’s make, model number, and serial number will be kept on file for future service requests and be considered the appliance on record for TAPP.
- By enrolling, the customer attests that, to the best of his/her knowledge, the basic residential appliances to be covered under TAPP are functioning properly, meet all applicable residential building codes, there are no pre-existing conditions, and they were installed according to the manufacturer’s specifications.
- All appliances must have the model and serial number tags to be eligible for service or any other program benefits. Units without the factory model/serial tag are NOT covered under TAPP.
- TACC shall have sole discretion to determine the type, make and source of parts and labor used in repairs. Any part or repair that is not included on the “Covered Items” lists in section “J” below is not covered.
- TACC is not responsible for manufacturer upgrades. Additional appliances require the purchase of additional coverage. See section “H” below for details.
- Appliances that are covered under TAPP must not have any remaining manufacturer’s warranty, as this type of service by TACC may void the manufacturer’s warranty. TACC will work with home owners to ensure service is covered under the appropriate service condition.
C. Effective Dates & Payment Agreement
- The service plan is for a contract year, and TAPP starts after the first payment is received. There is a 45 day waiting period from the date payment is first received. The service plan continues for one calendar year from the date the first payment is received. The contract will be automatically renewed after one year, for a one-year period, and each year thereafter so long as the customer makes timely payments as outlined in “C3” below.
- If home ownership changes, but not the appliances in the home, a new TAPP service agreement must be established by the new home owner. The new TAPP service agreements will be required to hold for a 45 day waiting period.
- Customer payments prepay coverage under TAPP. Pre Payment of the first 30 days includes the 45 day waiting period. The service plan is suspended at the end of the prepaid period in cases of nonpayment. Each service plan’s monthly coverage of non-payment is still considered under contract, but, the customer’s account must be in good standing (current, to include all months of past due payment) to receive repair service under TAPP. Failure to make timely payments may result in a late fee of one and one-half percent (1.5%) per month being charged against the outstanding balance.
- If you have received service and repair by TACC on your home appliances and wish to terminate your service plan within the Contract Year, you will still be responsible for the remaining monthly installments of the Contract Year. If you have not had service, you may request termination at any time. You may request termination by contacting TACC.
- Termination will become effective after TACC has processed your request to terminate coverage.
- If TACC estimates that the cost of a repair (including, without limitation, parts and labor) would be more than the value of your appliance in its then-current condition or if code violations exist, TACC may decline to make the repair and no liability will result from such decision. TACC will provide a cash allowance if the cost of a repair would be more than the value of the appliance. These cash allowance amounts are listed in section “I” below.
- TACC reserves the right to modify or cancel TAPP and/or to refuse service as to specific appliance(s) in the event you are in violation of the terms hereof, you commit any act of fraud or misrepresentation with respect to your participation in the TACC, or if the condition of the appliance(s) is in violation of applicable residential building codes and you do not bring the appliance(s) into compliance with applicable codes.
- If a customer wishes to add more than one of the same appliance type to their TAPP plan, this must be done at the time of initial sign-up. OR, once a TAPP plan is in place and customer wishes to later add a second or third appliance type to the plan, the original plan must be cancelled and the customer must enroll in a new TAPP agreement. The 45 day waiting period will be waived for those appliances on the previous TAPP agreement, but new appliances being added to the plan will be subject to the 45 day waiting period.
D. Requesting Service Under TAPP
- Service requests, calls, or website appointment requests are taken 24 hours a day, 365 days a year. You may reach TACC at (816) 331-1515 or schedule a service online at theappliancecarecompany.com. Repair services are provided Monday through Friday during normal working hours.
- An individual 18 years or older must be present at the time of service.
- All appliances must be readily available to the service technician.
- Appliance must be empty if possible.
- Appliance must be installed to normal connections set forth by national codes.
- TACC must have safe access to, and safe working conditions at and around any and all appliances requiring repair. Any additional or non-covered services performed at your request will be at a separate expense from your TAPP. All appliances must be operated in a year-round “Room Temperature” environment. Usage outside a room temperature environment will void the TAPP coverage plan.
- Intermittent Conditions – TACC reserves the right to charge additional $75 service trip fees if appliances do not present malfunctioning conditions during scheduled appointments. TACC will not replace parts on appliances in current running condition as preventative measures.
- If a technician arrives and is unable to perform a scheduled service because you did not comply with the terms of this agreement, you will be charged a $75 Service Call Fee.
- TACC technicians typically have high failure parts in their vehicle stock. Needed parts will be ordered. Depending on part availability, most parts will arrive within 2-14 business days. Special order parts may take longer. Once the part has arrived, the TACC office will contact the customer to schedule the parts installation. TACC reserves the right to retain old parts and components that have been replaced by a TACC service technician. TACC is not required to refund past TAPP subscription payments due to delays in replacement part delivery to TACC from the manufacturers of the parts.
E. Liabilities
- TACC shall not be responsible for charges resulting from service and/or parts you or others provide.
- TACC is not required to fulfill a TAPP obligation, if a policy holder first attempts to repair a covered appliance themselves.
- TACC will not be responsible for direct damages, consequential, special or punitive damages, food loss, illness or injury caused by delays, failure to service, unavailability of parts, labor difficulties, and other conditions beyond their control. TACC’s liability is limited to the amounts actually paid by you to TACC pursuant to the terms of this Agreement. In no event will TACC be liable for consequential, special or punitive damages arising from any cause whatsoever.
- TAPP is a non-transferrable and non-assignable.
